1. Scope of commercial terms and conditions

Mario Kiesenhofer is a professional photographer, commercial graphic designer and visual artist and runs an online store on the website www.mariokiesenhofer.com. For business transactions between you and Mario Kiesenhofer, these terms and conditions apply in the version valid at the time of the conclusion of the contract. Mario Kiesenhofer does not recognize other terms and conditions, including those represented by you, unless we have previously expressly agreed in writing to their invalidity. By placing an order you accept our terms and conditions, which at the same time become part of each individual purchase contract. Changes to the Terms and Conditions will be published on the website www.mariokiesenhofer.com, otherwise they will be invalid.

2. Conclusion of the contract

Statements and data contained in our price-lists, advertisements, brochures and website are always subject to change and not binding. We expressly reserve the right to change at any time the details contained in the above material. Any orders placed by customers are deemed to constitute offers to enter into a contract. Orders placed via our website are deemed to have been placed at the time the electronic order was received by us. The contract will only be concluded with the acceptance of the order. Acceptance of the order ensues at the latest upon delivery of the goods. After you have placed your order on our website www.mariokiesenhofer.com, you will receive a reply e-mail with all the details regarding your order. When we send the ordered goods to you, you will also receive an electronic information (confirmation of dispatch). You will also be informed if your order exceeds the amount of goods available in our warehouse, or if the goods exceptionally may not be delivered to you.

3. Saving of contract

The vendor stores the order of the buyer with the order data provided by the buyer. Additionally, the vendor stores the contract note with the General Terms and Conditions included in the contract. The buyer can save and print the order and contract confirmation sent to him by the vendor via e-mail. The buyer can click on, save and print the General Terms and Conditions during or immediately after the order process.

4. Conditions of payment

The buyer can pay for the order by “PayPal”. Any other means of payment is only possible after an express agreement with Mario Kiesenhofer in writing. Please contact us at: studio[at]mariokiesenhofer[dot]com

5. Delivery

We deliver our goods to all countries stated in our Shipping conditions. If no other arrangements are made, we deliver the goods to the given delivery address. Any information delivered by us referring to the availability of the product/article, delivery and dispatch are only for informational purposes and are not binding for us in respect to guarantee of delivery terms. Usually the goods are ready for dispatch within 72 hours (except weekends). You will be informed by e-mail about any delays. Deliveries are available while stocks lasts. If Mario Kiesenhofer does not have the product you ordered in stock, we reserve the right to withdraw from the purchase contract. The delivery will then not take place and you will be informed about this immediately. Mario Kiesenhofer reserves the right to charge the additional costs associated with shipping and delivery, even if they arise in connection with a non-delivery.

6. Prices

Unless otherwise stated, all prices quoted are gross prices including the statutory value added tax applicable in Austria, but excluding shipping and packaging costs. If export and/or import duties are levied in the course of shipment, these shall also be borne by the customer. We reserve the right to make changes. The calculation of the charges is made in euros.

7. Reservation of property right of a sold item

Delivered goods remain the property of Mario Kiesenhofer until full payment of the goods and delivery.

8. Warranty

The statutory warranty rights apply.

9. Court of jurisdiction

The exclusive place of jurisdiction for all disputes arising from or in connection with the contractual relationship is Vienna, Austria.

SHIPPING

a. Within Austria
Shipping charges within Austria amount to EUR 5,00.

b. Within the European Union (EU)
Shipping charges within the EU amount to EUR 10,00.

Belgium, Bulgaria, Croatia, Denmark, Germany, Estonia, Finland, France, Greece, Ireland, Italy, Latvia, Lithuania, Luxembourg, Malta, Monaco, the Netherlands, Poland, Portugal, Romania, Sweden, Slovakia, Slovenia, Spain, Czech Republic, Hungary, Republic of Cyprus

c. Rest of Europe
Shipping charges outside the EU amount to EUR 15,00. When a package is shipped internationally, it may be subject to import taxes, customs duties, and/or fees imposed by the destination country. These charges will typically be due once the shipped goods arrive at the country of destination.
 

You are responsible with ensuring to comply with laws and regulations of the country of destination. Mario Kiesenhofer does not have any responsibility on these additional charges that may apply.


Please note that certain countries may require certain documentation before the items are sent. If the necessary information is not provided, this may result in delays in the order.

Shipping charges outside Europe amount to EUR 25,00. When a package is shipped internationally, it may be subject to import taxes, customs duties, and/or fees imposed by the destination country. These charges will typically be due once the shipped goods arrive at the country of destination.

You are responsible with ensuring to comply with laws and regulations of the country of destination. Mario Kiesenhofer does not have any responsibility on these additional charges that may apply.

Please keep in mind that due to the The COVID-19 pandemic, the shipping may be impacted and it may not be possible to ship to all countries.

RETURNS
Consumers can withdraw from the contract concluded at a distance within 14 days of original purchase. However, we do not accept returns of artworks, since they are partly handmade fragile objects that are not suitable for return shipping.

If you wish to return an item, p
lease make sure that the goods you want to return have not been used or been damaged in any way and only send them back in new condition. The customer is responsible for all additional return shipping costs. Return shipping labels will not be provided. The additional or already paid customs duties and/or the additional VAT payment outside the EU due to an import into a third country (e.g. Switzerland) will not be refunded by us.
